Our Commitment to Quality
Niagara Gutter, Inc. guarantees our guttering systems against sagging, leaking, or malfunction due to improper installation for one year from the installation date. To maintain this warranty, regular, annual cleanings by the customer are essential.

NIAGARA GUTTER, INC. WARRANTY

This Labor Warranty certifies that the guttering systems installed by Niagara Gutter, Inc. are guaranteed for a period of one (1) year from date of installation against sagging, pulling loose, leaking or not functioning properly due to improper installation. It is the responsibility of the customer to schedule regular, annual cleanings to maintain gutter integrity. This warranty is not transferable.


What is NOT Covered in Labor Warranty

This Labor Warranty shall not extend to any defect or product failure resulting from:

(1) Natural, Act-of-God occurrences such as, but not limited to, heavy snow, ice build up, lightning, hurricanes, hail, earthquakes, flood, tornadoes, and falling objects;
(2) Damage to the property or structure to which gutter system has been installed caused by settling, cracking, movement, shifting, distorting, or splitting including but not limited to structural failure of walls, roofs, foundations, fascia, or rafters;
(3) Inadequate or improper ventilation of soffits and roof or accumulation of water, ice damming or mold due to structural deficiencies and/or insufficient drainage;
(4) Any deliberate act or negligence of the homeowner, workman, or any other person when installing or maintaining surfaces of structure to which materials have been applied;
(5) Normal wear and tear as per manufacturer specifications (in case of claim, manufacturing company will have final say if product will need to be replaced);
(6) Color fading, staining, replacement of any rotten wood, water behind gutters without eave metal, or any erosion;
(7) Any product added to the gutter system, not installed by Niagara Gutter, Inc. and/or any alterations/modifications made by the homeowner or anyone other than Niagara Gutter, Inc.
(8) Expansion or contraction of wood, rafters, windows, siding, roofing, concrete or trim;
(9) Improper maintenance of the gutter system by homeowner/customer, including, but not limited to clogging caused by leaves or debris in gutter. Gutters must be maintained on a regular basis. Niagara Gutter is not responsible for gutter maintenance.

(10) There is no warranty on pre-existing gutters or any repairs made to pre-existing gutters, such as re-pitching, patching, re-nailing, or where new gutters tie into pre-existing gutters. 

The main cause of customer complaints is gutters overflowing due to debris in the gutter. Niagara Gutter, Inc. is not responsible for general maintenance, inspections, and/or cleaning of gutter systems. Niagara Gutter, Inc. does not provide gutter cleaning services and gutter cleanings are not covered by any warranty. Any calls for warranty claims, requests for inspections or service calls made and cleaning is required or it does not fall under our one (1) year extended warranty, a fee will incur.

PLEASE NOTE THAT ANY SERVICE CALL REQUESTED AFTER 30 DAYS OF THE INITIAL INSTALL WILL INCUR A FEE IF NIAGARA GUTTER NEEDS TO CLEAN THE GUTTERS TO ACCESS THE REPAIR, IF WE FIND THAT THE REPORTED ISSUE IS DUE TO CUSTOMER NEGLECT OR DUE TO CLOGGING CAUSED BY LEAVES OR DEBRIS.

Rain gutters will not make a watertight seal against the fascia board. Water running between the gutter and fascia board or behind the fascia board is usually caused by one of the following:

Short, broken, or old curled-under shingles cause the water to wick back onto the fascia board. Pockets in roof shingles are caused by the top of the fascia board being higher than the roof decking, allowing the water to track between the shingles and down behind the fascia board. Water getting behind the fascia board may cause rotting of the roof decking, rafter ends, fascia board, or eave overhang. Water problems may also be caused by faulty or missing flashing around chimneys, vent stacks, wall flashing, etc.

Our gutter system does not cause these cases and is therefore not covered under our Labor Warranty.

Niagara Gutter will not be responsible for any peripheral needs or issues related to the gutter system. Issues include but are not limited to, leaf build-up or clogging, cleaning dirty gutters, drainage issues, and dry-well systems. Niagara Gutter will not replace a component of the gutter system if it is not faulty while replacing something faulty and under warranty. Niagara Gutter is not responsible for another person or contractor’s adjustments or modifications to the gutter system following our installation. Adjustments and modifications include:

  • Changing the roof’s pitch.

  • Overhanging of the shingle.

  • Any roof aspect related to the gutter system during our installation. For example, drip/rake edge.

  • Tampering with Leaf Relief

  • Adjustment to gutters, including tampering to hang lighting.

  • Any tampering other than basic cleaning.

Installation, removal, repair, adjustment, tampering, or re-installation of Niagara Gutter’s gutter system or component by anyone other than Niagara Gutter voids any warranties within this document.

Niagara Gutter shall not be liable for injury to persons or damage to property, structure, or contents or for incidental, special, or consequential damages for breach of any written or implied warranty on defects in workmanship.

THIS DOCUMENT IS YOUR WARRANTY AND BECOMES EFFECTIVE UPON RECEIPT OF PAYMENT IN FULL—NO REGISTRATION REQUIRED.
